Terms of Service

By using this platform (the “Service”), operated by Buildable San Diego, you agree to these Terms of Service. Read them carefully — together with the Disclaimer and Privacy Policy, they describe what the Service is, what it isn't, and how it can and cannot be used.

1. Use of Service

The Service produces preliminary feasibility estimates and AI-generated answers about San Diego zoning. All output is for informational purposes only. Output is not a substitute for professional architectural, legal, engineering, financial, or planning advice, and use of the Service does not create a professional relationship between you and the operator or any affiliated licensed professional. See the Disclaimer for a fuller description of what the Service does and does not do.

2. AI Q&A Assistant

The Service includes an AI assistant (powered by Anthropic Claude) that answers questions about San Diego zoning and your specific analysis. AI-generated answers are informational only and may be incomplete, outdated, or incorrect — including when expressed with confidence or accompanied by code citations. You agree not to rely on AI-generated answers as legal, architectural, engineering, financial, or planning advice. Verify every AI answer with the City of San Diego Development Services Department or a licensed professional before relying on it for any project decision. The operator makes no representation that AI answers are accurate, complete, or fit for any particular purpose.

3. Acceptable Use

You agree not to:

  • Use the Service in violation of any applicable law or regulation.
  • Attempt to access accounts or analyses belonging to other users.
  • Reverse-engineer, scrape, or copy the Service's underlying code, data, or AI prompts beyond your own normal use.
  • Use the Service to provide professional advice to third parties without an independent professional review and your own assumption of liability.
  • Submit content that is unlawful, infringes another party's rights, or is intended to abuse the AI assistant or other users.
  • Use automated means to circumvent the per-account analysis limits or AI rate limits.

4. Account Responsibilities

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us promptly at hello@buildablesd.com if you believe your account has been accessed without authorization.

5. Payment Terms

Paid subscriptions and bundles are billed in advance through Stripe. Bundle purchases (single-report, 5-site bundle) are non-refundable once analyses have been generated against them. Monthly and annual subscriptions may be cancelled at any time; cancellation takes effect at the end of the current billing period and no proration is provided. We may change pricing for new purchases at any time; existing subscribers' current billing terms remain in effect for the duration of their term.

6. Intellectual Property

The Service's software, design, copy, AI prompts, and underlying knowledge-base compilation are the property of the operator. You receive a personal, non-exclusive, non-transferable license to use the Service and the reports it generates for your own internal real-estate, development, or design-feasibility purposes. You may share generated reports and AI conversations with clients or collaborators, but you may not resell, redistribute, or repackage the Service or its outputs as a competing product. References to the San Diego Municipal Code, California statutes, and other government sources are made for descriptive purposes only and remain the property of their respective government entities — see the Disclaimer for the non-affiliation statement.

7. No Warranty

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied. The operator disclaims all warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement. The Service depends on third-party data feeds (City of San Diego GIS, SANDAG, FEMA, CAL FIRE, OpenStreetMap, Anthropic, and others); the operator does not warrant the availability, accuracy, or currency of those feeds.

8. Limitation of Liability

To the maximum extent permitted by law, the operator shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, opportunity, or goodwill, arising from your use of or inability to use the Service — including any reliance on analysis output or AI-generated answers. Total aggregate liability for any direct damages shall not exceed the greater of (a) the amount you paid the operator in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars (US $100). This limitation applies regardless of the legal theory of liability and even if the operator has been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless the operator and any affiliated licensed professionals from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service in violation of these Terms or any applicable law, (b) your reliance on Service output (including AI-generated answers) for project decisions without independent professional review, or (c) content you submit through the Service.

10. Termination

You may stop using the Service at any time. The operator may suspend or terminate your access for any violation of these Terms, for non-payment, or for prolonged inactivity. Sections 6 (Intellectual Property), 7 (No Warranty), 8 (Limitation of Liability), 9 (Indemnification), and 11 (Governing Law) survive termination.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Service shall be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.

12. Changes to Terms

We may update these Terms at any time. Material changes will be reflected in the “Last updated” date above; for substantive changes affecting paid subscribers, we will email the address on file. Continued use of the Service after a change constitutes acceptance of the revised Terms.
